The most important update on MedTech advertising

The Federal antimonopoly service (FAS) has clarified the latest update on advertising for medical devices and pharmaceitucal drugs for Russia

1. The presence of warning in advertising is obligatory for drugs, medical devices, medical services, including methods of prevention, diagnosis, treatment and medical rehabilitation

You can use any type of warning offered at the advertiser’s discretion:

– a presence of contraindications;

– a need to read the instructions for using the advertising object;

– a need to get expert advice.

2. How to calculate the appropriate area of mandatory warning according to paragraph 1 above?

It should be calculated based on the ratio of the area of the entire ad layout (ad) and the area of space occupied by the warning text.

At the same time, the calculation of the area of such a warning (inscription) is carried out based on the analogy with the so-called “font size”, accepted in publishing.

3. Advertising that require special expertise

The issue of assigning medical devices to devices that require special expertise is not within the competence of the FAS of Russia. If such questions arise, the territorial bodies of the Federal Antimonopoly service of Russia are recommended to send appropriate appeals to the Ministry of health of the Russian Federation.
